These Terms & Conditions govern the contractual relationship between :

Referred to as « the Seller »,
Any person, businesses or private customers, wishing to consult and make a purchase on the Seller’s « Website » : www.jvanwiele.com.
Referred to below as the « Customer ».
They are both referred to below as the « Parties ».
Any connection to www.jvanwiele.com or any order placed on the Website are subject to the unconditional acceptance of These Terms & Conditions, to the exclusion of any conditions previously available on www.jvanwiele.com and to the exclusion of any terms and conditions of the Customer.
The Seller reserves the right to update, change, modify, delete or otherwise alter these Terms & Conditions and any information on www.jvanwiele.com without prior notification. The applicable Terms & Conditions to the Customer will be those available on the website on the date he is connected and the order is placed.
The Customer must be at least 18 years old or have legal capicity or parental authorization to be allowed to make a purchase on www.jvanwiele.com.
www.jvanwiele.com allows the Seller to sell clothing items and accessories produced by/for J.VANWIELE as well as selected clothing items, shoes and accessories from other brands.
Pictures on the Website are as accurate as possible but cannot ensure complete similarity with the product offered.
Products offered are subject to stock availability. Despite the effort made, if some or all of the items are unavailable, the Seller will inform the Customer as soon as possible through email. The Seller will offer the Customer the choice between waiting for or canceling the order of these unavailable items without any fees.
Prices are those shown on www.jvanwiele.com when the order is placed.
Prices are in Euros and include V.A.T. but exclude transportation and delivery fees.
Transportation and delivery fees are calculated and added to the selected products at the end of the order process.
The Seller reserves the right to modify at any time the selling prices listed on his Website. Nevertheless the applicable prices to the Customer will be those listed at the time of his order validation.
According to certain countries outside the E.U., custom duties and other local taxes may apply depending on the local regulations. Such additionnal costs will be at the Cutomer expenses.
After reading the product description the Customer can add selected items to his shopping cart. Once the shopping cart is validated, the Cutsomer has to fill in all of the required information needed to process his order, and then confirm his order.
The Customer is solely responsible for the information provided. The Seller cannot be held liable for the consenquences of communicating erroneous information provided by the Customer when placing his order.
By confirming his order the Customer accepts these Terms & Conditions, recognizes their thourough understanding, and excludes any terms and conditions of his own.
The Seller will send the Customer an order confimation once the payment is accepted. This order confirmation will seal the purchase contract between the Seller and the Customer.
The Seller reserves the right to refuse any abnormal orders, and for different reasons, such as for example, erroneous personal data, or if the Customer has a history of bad payments or excessive returns.
On www.jvanwiele.com the Customer will only be able to pay his order with selected credit cards and debit cards.
Cards are charged when the order is confirmed, provided that the payment has been authorized by the appropiate payment center. If not, the order will not be taken into account.
The order will be delivered to the address provided by the Customer to this effect.
The Seller do not send orders via express carriers.
For Belgium and Belgium’s neighboring countries, handling orders will take 1 to 4 business days from the first business day after the order is received. Variations in the handling of order will be notified to the Customer on the email he provided or mentionned on the Website.
Time of delivery from depends on the carrier, Bpost, and the order’s destination.
The Seller’s takes responsibility for the parcel until it is delivered to the Customer. From reception, the Customer bares all risks and responsibilities.
7- Right of withdrawal & refunds
According to Belgium law the customer, if not professionnal, has the right to withdraw from the order within 14 days, starting from the day of delivery, without penalty nor stating reasons. In case of failure to comply with this time limit, the Customer will lose the right of withdrawal and cannot under any circumstances demand reimbursement of his purchase.
The Right of Withrawal does not apply to the Customer who is a professional. The Right of Withdrawal is not applicable to customized goods to the Customers specifications, or customized, nor to goods that cannot be shipped back by nature, that can deteriorate or expire rapidly.
The Customer will exercise his right of withdrawal by sending an email to the Seller at the following email address : firstname.lastname@example.org by stating his full name, his order number, and optionally, the withdrawal reason.
Only the purchase items will be refunded, delivery fees will be at the Customer expenses.
The Seller will proceed to refunds of the returned item(s), to the exclusion of the delivery fees, within 30 days after receiving notification of withdrawal from the Customer and on the same card the Customer used to make his order on www.jvanwiele.com.
The Seller reserves the right to postpone refunding the Customer until reception of returned goods or proof of returning goods shipment by the Customer.
8- Exchanges :
Within 14 days from the day starting from the day the order is received, the Customer can request to exchange an item by sending an email to email@example.com
The Seller will try his best to respond favourably to the Customer’s request. However, the Seller might refuse without having to state any reasons.
If the exchange is accepted, return shipment is at the Customer’s expenses, whereas the Seller will be responsible for the re-shipment of the desired item(s).
9- Returns :
Returned items must be shipped back with their original and entire packaging (i.e. :box, dustbag, labels, accessories…) Parcels must be properly conditionned.
Items returned must new, not worn nor washed.
Furthermore, the Customer should not remove the labels on J.VANWIELE clothing.

Only returns complying with the return policy here above stated will be reimbursed.
Returns are to the Customer’s risks and expenses.
10- Limited warranty
In accordance with the September 1st, 2004 law governing the Customer’s protection, the Seller warrants the products he is selling.
The Customer must verify the compliance of the item(s) received upon receipt.
If there is any lack of conformity, the Customers must inform the Seller without delay at : firstname.lastname@example.org, up until two months from the day the order is received.
The warranty only covers the lack of conformity upon delivery.
The order confirmation acts as the warranty and must be kept by the Customer.
11- Limitation of Liability
The Seller, in the process of on-line sale, is held only by a best effort undertaking ;
The Seller, is not liable for any direct or indirect damages incurred by the use or the access of www.jvanwiele.com.
In the case of direct or indirect references to third party’s websites (hypertext links), The Seller cannot be held responsible for their content and any (in)direct damages resulting from the use of these sites. The links provided are for informational purposes only.
12- Personal data
Pursuant to the Act of the 8th december 1992 (modified on the 11th of March 2003) and all the related regulations, the Seller, will respect the user’s privacy when processing of personal data.
Although most of the information is available on www.jvanwiele.com without the user having to provide any personal data, some may be asked. In that case, the information provided by the user will only be retained for a limited duration in a computer file.
Personal data will not be commercialized and the Seller will undertake to take all necessary precautions in the security of the User’s personal data, in particular to prevent these from being communicated to unauthorized parties. However – if necessary – data of personal nature may be communicated a the request of the legal authorities or police services without the owner’s prior consent.The Customer has the right to access, rectify, amend and delete data concerning him, free of charge and at any time, by a simple request addressed to La compagnie de Julie SPRL at email@example.com.
13- Intellectual property rights
All content on www.jvanwiele.com, including, but not limited to: informational content, graphic elements and images, animations, interactive applications, videos, photos, texts, animations and drawings are the Seller’s copywrited material and may not be reproduced, adapted or modified in any manner without Julie Guyon or La Compagnie de Julie SPRL expressed written consent.
Some names, logos and distinct materials referred to in the Website are the trademarks and registered trademarks to Julie Guyon and La Compagnie de Julie SPRL, headquartered at Rue de Crayer 6, 1000 Bruxelles. Use and/or reproduction of these names, logos and materials are strictly forbidden without Julie Guyon or La Compagnie de Julie SPRL written consent.
14- Partial Invalidity :
If any provisions of these Terms & Conditions are held to be invalid or declared such under any law, regulation or following a final decision of a competent jurisdiction, such provision shall nonetheless be enforced to the fullest extent permitted and the other provisions shall remain in full force and scope.
15- Governing Law :
Relations between the Customer and the Seller, including sales, are exclusively governed by Belgian law.
Both parties will do their best to resolve disputes amicably.
The Brussels courts have exclusive jurisdiction in the event of disputes between the Customer and the Seller. Proceedings shall be conducted in the French language.
All parties accept the validity of electronic proof in the framework of their relations.
